Important: By accessing or using the Laborde Motorsport platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use in their entirety. If you do not agree, you must not use our services.

1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the Laborde Motorsport website, client portal, and all associated digital services (collectively, the "Platform"), operated by Laborde Motorsport ("we", "us", "our"), a business registered and operating in Western Australia, Australia.

These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. Any dispute arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.

Laborde Motorsport provides professional digital ECU (Engine Control Unit) file patching and modification services. Our services include, but are not limited to:

Please read this section carefully. ECU modifications may affect your vehicle's compliance with road laws, manufacturer warranties, and emissions regulations. It is your sole responsibility to ensure your use of our services is lawful in your jurisdiction.

7. Payment and Pricing

All prices are displayed in Australian dollars (AUD) unless otherwise stated. Payment is required in full prior to the processing and delivery of any patched file. We accept payment via Stripe and PayPal in accordance with their respective terms and conditions.

Prices are subject to change without notice. Goods and Services Tax (GST) may be applicable to purchases made within Australia in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

8. Delivery of Services

Upon successful payment, we will process your ECU file and deliver the patched file to the email address associated with your account. Patched files will also be available for download through your client portal for a period of 30 days from the date of delivery, after which the file will be permanently deleted from our servers. A record of the transaction and job details will be retained for the purposes of account history and support.

While we endeavour to process all files promptly, delivery times are estimates only and not guaranteed. We accept no liability for delays in delivery.

9. Intellectual Property

All patching methodologies, software tools, map databases, and associated intellectual property developed and used by Laborde Motorsport remain our exclusive property. The delivery of a patched ECU file grants you a limited, non-exclusive, non-transferable licence to use that file for your personal or business use only, in accordance with these Terms.

You retain ownership of the original ECU file you upload. By uploading a file, you grant us a limited licence to process that file solely for the purpose of delivering the requested service.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. Where any such guarantee applies, our liability is limited, to the extent permitted by law, to the re-supply of the services or the payment of the cost of re-supplying the services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Laborde Motorsport, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of our Platform or services, including but not limited to vehicle damage, loss of data, loss of profit, or loss of business opportunity.

Our total aggregate liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

12. Privacy

We collect, use, and store personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using our Platform, you consent to our collection and use of your personal information as described in our Privacy Policy. Your personal data will not be sold or disclosed to third parties except as required by law or as necessary to deliver our services (e.g. payment processors).

13. Modifications to These Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Platform following any such amendment constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or if we are required to do so by law. Upon termination, any pending service orders may be cancelled and refunded at our discretion, subject to our Refund Policy.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any dispute arising from or in connection with these Terms or your use of the Platform.
